Recently, Fields & Brown successfully defended a workers’ compensation claim in Kansas for an automotive manufacturer.  The claimant alleged a repetitive back injury caused by his employment with the manufacturer.  At the preliminary hearing, Fields & Brown focused on the claimant’s lack of credibility by introducing evidence that the claimant had falsely reported a personal injury as work related several years ago.  The claimant’s testimony was also impeached by Fields & Brown when he testified about the longevity of his symptoms in stark contrast to his testimony at a prior deposition.  Fields & Brown also provided opinions from the claimant’s treating physician as well as a retained expert that the injury sustained by the claimant was acute and that there was no evidence of the claimant’s injury being work related.  As a result of the defense put on by Fields & Brown, the Administrative Law Judge found in favor of the manufacturer and found no compensable work injury was sustained, thereby denying all claims and benefits made by the claimant.  Troy Larson handled this matter for the firm.
